User Agreement to Policy
Acceptance of Terms: By uploading an image and placing an order with The Manila Clothing LLC, you confirm that you have read, understood, and agreed to be bound by this policy. This agreement is effective upon your use of our services and remains in effect until terminated by either party.
Responsibility for Compliance: You are solely responsible for ensuring that your use of our services complies with this policy and all applicable laws and regulations.
Customer’s Responsibility
Image Rights and Permissions: When you upload a design to The Manila Clothing LLC for DTF transfer printing, you affirm that you have the legal right to use the image. This includes ensuring that the image does not infringe on the copyrights, trademarks, or other intellectual property rights of third parties.
Indemnification: You agree to indemnify and hold harmless The Manila Clothing LLC, its affiliates, officers, agents, employees, and partners from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising from your violation of these terms, your violation of any rights of another, or any content you submit, post, transmit, or otherwise make available through our services.
Content Verification: While The Manila Clothing LLC does not review content for legal compliance, we reserve the right to refuse to process any order that we believe may infringe on the rights of a third party or violate any laws.
The Manila Clothing LLC’s Limitation of Liability
No Responsibility for Uploaded Content: The Manila Clothing LLC is not responsible for the content of the images uploaded by customers. Our role is strictly limited to printing the designs onto DTF transfer sheets as per the customer’s instructions. We only use the designs to fulfill orders, and we reserve the right to use them only for marketing purposes on social media channels.
No Redistribution or Sharing: We do not redistribute, share, or otherwise make public any images uploaded by our customers. All uploaded content is considered confidential and is used solely for fulfilling your order.
Limitation of Liability: In no event shall The Manila Clothing LLC, its officers, directors, employees, or agents be liable for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any (i) errors, mistakes, or inaccuracies of content, (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our services, (iii) any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein.
Intellectual Property
Respect for Intellectual Property: The Manila Clothing LLC respects the intellectual property rights of others and prohibits users from uploading, posting, or otherwise transmitting on our website any materials that violate another party’s intellectual property rights.
Notification of Infringement: If you believe that your work has been copied in a way that constitutes copyright infringement, please provide us with the following information: a description of the copyrighted work that you claim has been infringed; a description of where the material that you claim is infringing is located on the site; your address, telephone number, and email address; a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
